LETTER OF AGREEMENT

 Between

 BURLINGTON NORTHERN SANTA FE RAILROAD

And

 UNITED TRANSPORTATION UNION

 

Section 1.        Permanent vacancies for Yard Foreman and Yard Helper positions in Willbridge Yard and OE 12th Street yard will be filled in the order listed on Attachment A.

Section 2.        Employees designated in Section 2(a) and (b) of the Portland/Vancouver Terminal Consolidation Agreement signed December 20, 1972, may displace to Willbridge Yard and OE 12st Street Yard, Foreman and Helper positions upon twenty-four (24) hours notice.

Section 3.        Temporary vacancies will be filled under provisions of the former SP&S Schedule for Yardmen from the appropriate Yard Extra Board.

Section 4.        Restrictions on movement from road to yard service or visa versa will not apply to employees designated in Section 2(a) and (b) of the Portland/Vancouver terminal Consolidation Agreement.

 

The terms and conditions of this agreed to understanding will become effective     June 15th               ,  2000       , and remain in effect as approved, subject to cancellation by either party giving the other party not less than twenty (20) days written notice of their desire to cancel.  Upon such cancellation, the conditions and requirements preexisting will once again come to full force and effect.

WILLBRIDGE YARD - 12th STREET 

Permanent foreman positions are filled at Willbridge and 12th Street in the following order:

1.      Senior Conductor holding prior rights on the A&C

2.      Senior Conductor holding prior rights on the OE

(NOTE: The foregoing is for filling foreman posi­tions on Willbridge assignments. Reverse 1 and 2 for filling vacancies on 12th Street assignments)

 

After application of Paragraphs 1 and 2, the following governs both 12th Street and Willbridge:

3.                   Senior Conductor holding prior rights on former SP&S (mainline)

4.                   Senior conductor holding seniority in road service prior to merger (includes all former NP)

5.                   Former prior right SP&S and GN yardmen receiving a merger date as Conductor. (NOTE: Such employees will exercise seniority amongst themselves based on their employment dates as helpers)

6.                   New hire employees promoted to Conductor on or before September 15, 1973. (Effective date of Award 130)

7.                   Prior right road service employees who do not hold Conductor seniority but are qualified to work as yard foremen.

(NOTE: In application of this paragraph 7, the order provided for in paragraphs 1, 2 3 and 4 will be followed)

8.                   SP&S prior right yardmen (Portland-Vancouver yardmen).

9.                   GN prior right yardmen.

(NOTE: It is understood in the application of para­graphs 1 through 9 such employee has submitted a bid for this position.)

 

10.               New Hires promoted subsequent to September 15, 1973.

 
Helper positions are filled in accordance with seniority as brakemen as follows:

1.                   A&C - OE
(See paragraphs 1 and 2 of permanent Foreman vacancies)
2.                   SP&S Mainline
3.                   NP & GN Trainmen
4.                   SP&S Yardmen
5.                   GN Yardmen
6.                   New hires
