Oregon Electric Assigned Pool Agreement (OE Pool)

 

 In order to address fatigue, and the issue of rest days, the following is agreed upon:

1. An assigned pool, with a minimum of two (2) turns will be established at Vancouver, WA working between Vancouver, WA and Albany, OR. This assigned freight service pool is to be initially set up with two (2) pool turns, assigned under 1955 SP&S Trainmen’s Schedule, Rule 26, with the senior assigned Conductor taking the first turn. It is further understood that Albany, OR remains an automatic release point and Rule 54 of the 1955 SP&S Trainmen’s Schedule remain in effect. The OE Pool will be regulated by the Organization under existing rules.

2. Line Miles for this pool will be set at 199 miles per trip. Deadhead miles will be included into the 199 miles for the run. Overtime will accrue after twelve (12) hours.

2.1. This OE pool will do all required dogcatching. It is understood that in the event a crew is required to dogcatch a train to Albany, and then required to return on another train, there will be a penalty of a basic day assessed.

3. This pool will work a 5/2 work/rest cycle with rest cycle days off on Sunday and Monday. Rest cycle will start at 0700, or tie up time, whichever is earlier, and employees will be marked up at 0659, following their cycle rest days. Vacancies will be filled from the extra boards. Provisions of Section 2 above will apply to those filled vacancies.

4. A Conductor on this work/rest pool will be automatically laid off from this pool during his/her assigned rest cycle, and automatically marked up upon expiration of his/her rest cycle. Employees beginning their work cycle will be available to be called for assignments that begin on or after the 0700 work cycle time. The latest on duty time will be one (1) minute before the end of the employees' work cycle.

5. Conductors may return to service before the expiration of the rest cycle at any time with twelve (12) hours prior notification to Crew Support. A Conductor who desires to continue working through all or part of his/her rest cycle must notify the crew desk of this desire to work through the rest cycle not less than twelve (12) hours in advance of the scheduled start time of the rest cycle. A Conductor who chooses to remain marked up must be available to be called to work during the time specified in his/her request.

 

6. Conductors who lay off completely within the assigned rest cycle will not be considered in violation of any attendance guidelines, regardless of the number of weekend or total days absent. Lay offs taken during the work cycle will fall under any attendance guidelines. It is understood that the days available for lay off outside the rest cycle will be based on the total days available for the month.

6.1. In regards to the Availability Guidelines, only one (1) day will be counted for each 24-hour period, when an employee lays off or is otherwise unavailable for service.

All other Schedule Rules remain in effect except as specifically modified herein.

The above conditions will become effective March 1, 2002 and will remain in effect until or unless canceled by twenty (20) day written notice by either party signatory hereto served upon the other party.
