RE: Trip Rates

Mr. Fitzgerald, be advised there are some real problems with the pending trip rates for Vancouver, WA.

I took the earnings statements of pre-1985 employees working at Vancouver, WA in the ID pool and inserted the trip rates. Employees working the Vancouver/Pasco ID pool on average had a net loss of $200 - $300 for a pay period.

Trip rate for the regular assigned Interdivisional assignments are $30 a trip higher than the ID pool. The assigned jobs are through freight and run the same mileage as the ID pool.

Prior to trip rates the ID pool had a higher Merger Guarantee job rating/earnings.

If this cannot be resolved with the carrier, I ask that this issue be elevated under the provisions of Article 5 Section 6 of the 2002 National Agreement


ARTICLE V, Section 6 - National Disputes Committee
A National Disputes Committee ("Disputes Committee") is established for the purpose of resolving any disputes that may arise under this Article. Such Committee shall consist of the President of the UTU and the Chairman of the NCCC, and a neutral Chairman selected by the parties or, absent agreement, appointed by the National Mediation Board. Each partisan member may select others to serve on the Committee at his discretion. If the partisan members of the Committee are unable to agree on resolution of any dispute within ten (10) days after convening, the matter will be referred to the neutral Chairman for resolution, The neutral Chairman will resolve the dispute within ten (10) days after referral of the matter. Each party shall bear its own costs and shall equally share the fees and expenses of the neutral. Any resolution by the Committee or by the neutral shall be final and binding and shall be enforceable and reviewable under Section 3 of the Railway Labor Act.

Dear Mr. Schollmeyer:

I am in receipt of your letter of March 5, 2004, concerning trip rates an concerns you raise therein. The information and data you have provided thus far pose serious questions for the trip rate for pool 200 (Pasco ID Pool)

If corrections cannot be made, the issue will be forwarded to the dispute committee as set forth in the August 20, 2002, UTU National Agreement.

Further, be aware additional problems exist based on subsequent correspondence from BNSF (copies attached) which I believe improperly extends overtime run of of miles. The issue has been raised with Labor Relations based on pas settlements concerning ITD, FTD and overtime issues. If correction is not mad€ this issue will proceed to the disputes committee as well.

Please advise of any additional pertinent data or issues.
