Re: Transfer of Personal and Confidential Employee Information by BNSF to a Third Party

Dear Sir and Brother:

This is in regards to the above reference as raised by a member of this General Committee.

I was advised today by Bruce Mullberg that the BNSF has transferred statements of his earnings, his social security number, address, telephone, hire date and other personal employer data to "The Work Number," a separate company doing business with BNSF. Mr. Mullberg did not authorize or request transfer of this information to that third party.

Upon contact by Mr. Mullberg, the undersigned inquired of other members and was advised they, too, had received the enclosed information with their pay check (copy enclosed).

First, I question the logic of BNSF transferring, en masse, all information on all employees to a third party. Second, I question the legality of such transfer.

This will serve as request that your office review and advise on legality as well as potential harm if that information is sold or transferred by "The Work Number" to some other entity or party.
